Terms of Service
Boilerplate pending legal review. This document is provided for product launch readiness and does not constitute legal advice.
These Terms of Service (“Terms”) govern your access to and use of the Sudoke mobile application, related websites, and services (collectively, the “Service”). The Service is operated by La Empresa Cooperativa, a group of independent developers publishing Sudoke under a developer name (“we”, “us”, or “our”). By creating an account, signing in with a third-party identity provider (such as Google), or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may only use the Service with permission from a parent or legal guardian who agrees to these Terms on your behalf.
2. Accounts
You may play as a guest or create an account. Account features (including ranked submission, rating, leaderboards, streaks, and friends) require authentication. You are responsible for activity under your account and for keeping your credentials secure. You must provide accurate information and may not impersonate others or create accounts for abusive purposes.
3. Acceptable use
You agree not to:
- cheat, automate, or manipulate ranked play, leaderboards, ratings, or challenges;
- harass, threaten, or abuse other players;
- reverse engineer, scrape, or overload the Service except as allowed by law;
- upload malware or attempt unauthorized access to our systems or other users’ data;
- use the Service for any unlawful purpose.
We may investigate suspected violations and take action including warnings, result invalidation, temporary suspension, or permanent termination.
4. Ranked play and fairness
Ranked (daily) puzzles, ratings, leaderboards, and related competitive features are provided for entertainment. We may adjust scoring, rating formulas, anti-cheat checks, puzzle schedules, and eligibility rules. Provisional ratings, under-review statuses, and finalization jobs may change how results appear. We do not guarantee continuous availability of any competitive feature.
5. Content and intellectual property
The Service—including puzzles, software, branding, and UI—is owned by us or our licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial play. You may not copy, distribute, or commercially exploit Service content without our prior written permission, except for limited personal sharing of your own results as enabled by the app (for example challenge links).
6. Third-party services
The Service may rely on third parties such as authentication providers (for example Clerk), analytics, crash reporting, and advertising networks. Their terms and privacy practices apply to their processing. We are not responsible for third-party services we do not control.
7. Ads and optional purchases
The Service may display advertisements. If we offer optional purchases or subscriptions in the future, additional terms will apply at the point of purchase. Platform store terms (Apple App Store, Google Play) also apply to in-app transactions.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LA EMPRESA COOPERATIVA AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50). Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
10. Indemnity
You agree to defend and indemnify us against claims arising from your misuse of the Service, your violation of these Terms, or your infringement of others’ rights, to the extent permitted by applicable law.
11. Termination
You may stop using the Service and delete your account in the app (Profile → Account → Delete account). We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations, and indemnity) will survive termination.
12. Changes
We may update these Terms from time to time. Material changes will be indicated by updating the effective date and document version. Continued use after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
13. Governing law and disputes
These Terms are governed by the laws applicable where the operators principally publish the Service, without regard to conflict-of-law rules, except that consumers in the European Economic Area (EEA), United Kingdom, or Switzerland retain any mandatory protections of their country of residence. Courts in your place of residence may have jurisdiction for consumer disputes as required by local law. Nothing in these Terms limits rights you cannot waive under local consumer protection law (including US state law and EU consumer law).
